GENERAL CONDITIONS OF SALE OF THE TICKETING SERVICE OF THE FRENCH BASKETBALL FEDERATION
1.SCOPE OF APPLICATION
The present general terms and conditions of sale of the ticketing service of the French Basketball Federation (the "General Terms and Conditions of Sale" or "GTC") govern the sale of Tickets as well as the terms and conditions of use of said Tickets.
1.1. The Terms and Conditions of Sale automatically apply to the sale or provision (individually) by the French Basketball Federation of Tickets allowing access to any natural person or legal entity - including the host territory and the licensees of the FÉDÉRATION FRANÇAISE DE BASKETBALL - who places an order either online via the Ticketing Portal or on paper by post.
1.2. No particular condition can prevail over the present GCS, except with the prior written agreement of the French Basketball Federation.
1.3. Any order or purchase of Tickets implies the Buyer's (or Subscriber's) full and unconditional acceptance of the GTCs. To materialize this adherence, the Purchaser must check the box provided for this purpose on the Order Form or the Online Form. Otherwise his order will not be taken into account. The Purchaser declares that it has full legal capacity and/or any authorization that may be necessary to enter into such an agreement. The validation of a Ticket, together with the fact of entering the stadium by means of the Ticket, constitutes irrevocable acceptance of the Internal Regulations of the stadiums by the Holder of the said Ticket. The Internal Regulations may be consulted at the entrances to the Arena.
1.4. The rights and obligations resulting from the GTC are automatically applicable to the new Ticket Holder by operation of law, by virtue of the transfer of the Ticket under the conditions set forth in Article 6 below.
2.ACCEPTANCE OF THE TERMS AND CONDITIONS
The acquisition of an access ticket (or "Ticket") entails unreserved adherence to these GTCs and to the Rules and Regulations of the arena where the event takes place. Any person in violation of the aforementioned documents may be refused entry to the sports arena or may be expelled from the arena without being able to claim a refund for their access ticket.
The Customer is aware that in order to ensure the safety of the public during an event, it may be filmed by the video surveillance system placed under the control of judicial police officers and likely to be used in the event of criminal prosecution. Access to the arena in the context of an event organized by the French Basketball Federation will be refused to any minor not accompanied by an adult with an access permit of the same nature as that of the minor (category, location, etc.).
3.GENERAL INFORMATION ABOUT TICKETS
Ticket prices are indicated in euros, all taxes included (VAT included), excluding shipping costs. All orders, whatever their origin, are payable in Euros. The Seller reserves the right to modify its prices at any time but it is agreed that the tickets will be charged on the basis of the rates in force at the time of order registration.
Tickets for events remain the property of the organizer of the event until full and final collection of the price by the French Basketball Federation or its agents. Consequently, the latter cannot be held responsible for any change in sectorisation of typology and seat category decided by the organiser of the event between the order and the publication of the tickets. For certain events, the selling price offered by the Seller may be higher than the value indicated on the access ticket due to acquisition fees or commissions charged by the suppliers as well as management, intervention and/or processing fees applied by the Seller. It is agreed that only the category indicated on the access ticket and as chosen by the Customer during the order process will be deemed authentic in the event of any dispute concerning the choice of the said category upon receipt of the tickets.
The limit of seats per order for an event is set by the organizer. In the event of non-compliance with this limit, orders may be cancelled in their entirety at the Seller's sole discretion. Persons requesting more tickets than the regulations allow may be excluded from the allocation, even after the tickets have been issued.
4.AVAILABILITY OF TICKETS
Ticket reservations for events organized by the French Basketball Federation are made in real time. In this context, the server set up informs you in real time about the availability of tickets when you place your order. Orders concluded with the Seller constitute firm and definitive orders.
Due to the very high demand, the scarcity of supply and the particular marketing mode of certain events, the categories of seats by our suppliers may differ from the initial request. In the situation where the order is placed on the Internet, the Customer declares that he is aware of the characteristics of the Internet, and in particular that Internet access may be saturated at certain times of the day, for reasons totally beyond the control of the Vendor (poor telephone connections, maintenance, traffic saturation, etc.). Under these conditions, the French Basketball Federation cannot be held responsible for the occurrence of the risks mentioned above.
5.SITUATION OF THE SEATS
If given the opportunity, the Customer chooses the location he wants for the chosen event according to the available places. The allocation of seats is carried out in the order in which the reservations are registered and does not in any case constitute a contractual commitment on the part of the French Basketball Federation regarding the actual location of the seats. By default, the seats in the same order are grouped together, by row, block, or door. As far as possible, the seats of the same order are contiguous. However, it may happen that the seats are separated, in which case the services of the French Basketball Federation will try to obtain the closest possible distribution within the limits of technical possibilities.
6.ORDER AND PAYMENT
It is first reminded that the price of the access vouchers is payable in cash on the day of the order. Payment is made by credit card bearing the CB logo. In addition, the automatic order recording system is considered as proof in case of a possible dispute. Finally, the information provided by the Customer when placing an order is binding on the Customer, particularly in the event of an error in the wording of the recipient's contact information. The Seller uses a secure payment system in order to guarantee the Customer the greatest security. Only the amount indicated is debited. Confidential banking data is encrypted according to a security protocol and transmitted to a bank server. No intermediary can have access to this information.
The Seller never holds the Customer's bank card number, only the bank server automatically checks and processes it. The order validated by the Customer will only be considered effective when the bank payment centers concerned have given their agreement. The Seller confirms acceptance of the sale to the Customer by sending an email to the address provided by the Customer. In the event of refusal by the said centers, the order will be automatically cancelled and the Customer will be notified by e-mail.
7.WITHDRAWAL OF THE ACCESS TITLE OR TICKET
According to the modalities defined by the Organizer and/or the Seller, one or more withdrawal modes will be proposed to the buyers. The different available modes will be proposed to the purchaser at the time of his order taking (on the Order Form or on the reservation page).
7.1. "E-TICKET" PRINTING
The tickets are dematerialized; that is to say that they are in the form of e-tickets that you have to download and then print on a blank A4 sheet of paper. The e-tickets to be printed can be downloaded from the " MY ACCOUNT " tab " MY E-TICKETS ".
The access tickets sold by the Seller generally take the form of "e-tickets", i.e. access tickets that can be printed on A4 paper. The "e-ticket" access ticket must be printed by the Customer, and the access ticket can be downloaded from the Customer's personal space at any time. The "e-ticket" access ticket is valid only under the following conditions: it must be printed on white A4 paper, blank on both sides, without any change in print size, in portrait (vertical) format. No other medium (electronic, computer screen, cell phone screen...) will be accepted.
A partially printed, soiled, damaged or illegible access ticket will not be accepted and will be considered invalid. In the event of an incident or poor print quality, the Customer will have to print the digital file again. In order to verify the good quality of the print, the Customer will make sure that the information written on the access permit and the bar code are legible. Consequently, before ordering an access ticket, the Customer must ensure that it has the software and hardware configuration required to print its "e-ticket": a computer connected to the Internet and equipped with Acrobat Reader software and a printer. The Customer must test prior to the order that the printer used allows the e-ticket to be printed correctly.
The French Basketball Federation declines all responsibility in the event that the Customer is unable to print his "e-ticket" due to failure to comply with the software and hardware configuration set out above. It is strictly forbidden to reproduce, duplicate or forge this access title in any way whatsoever. The reproduction of the access title and the use of the copy of this access title are liable to prosecution. The French Basketball Federation declines all responsibility for any anomalies that may occur during the ordering, processing or printing of the access title, insofar as the French Basketball Federation has not caused them intentionally or as a result of negligence, as well as in the event of loss, theft or illicit use of the access title. The number of the access card and the bar codes guarantee the uniqueness of the passage during the control.
The first person to present the access permit is presumed to be the legitimate bearer and will be allowed to attend the event, regardless of the name appearing, if any, on the access permit. During the controls, the Customer must be in possession of an official, valid, photographic ID: identity card, passport, driving licence or residence permit. Family booklets are accepted for children. The Customer must keep this document for the duration of your presence at the event.
7.2. POSTAL SENDING
If the service is offered, the Customer may also receive his order by registered letter with acknowledgement of receipt at the address communicated to the Seller, subject to payment of a flat-rate surcharge specified at the time of the order. The Seller will send the proof of payment as well as the tickets to the address indicated by the Customer during the order process (home or other address). In the event of a change of address subsequent to the order, the Seller shall not be liable if the order has been shipped to the shipping address indicated during the order process. It is up to the Customer to make arrangements with the Post Office to forward his mail in the event of a change of address. No compensation or reimbursement can be granted for any prejudice resulting from the postal return to the sender after the date of the event or making it impossible to return the tickets or to organise their collection on site.
8. CANCELLATION AND REIMBURSEMENT
It is first recalled that, in accordance with the provisions of the Consumer Code applicable to these Terms and Conditions of Sale, the Customer has no right of withdrawal. A ticket cannot be refunded, taken back or exchanged, even in the event of loss or theft, nor can it be taken back or exchanged, except in the event of the cancellation of a show and the Organizer's decision to refund the tickets. In the case of a cancellation or postponement decided by the organizers, the order will be refunded in full, including shipping costs, subject to the return of the tickets received by the customer from the Seller. A ticket cannot also be resold. No duplicate of the ticket can be issued even in case of loss or theft. For certain shows, the Organizers reserve the right to postpone, modify dates and times, prohibiting any request for cancellation and reimbursement of customers who are unable to attend until the day of the event.
This peculiarity concerns sports events where the days and times of the performance are indicated with reservations and may be subject to changes decided by the Organizers without this giving rise to any right to compensation or refund in the event that the client is unable to attend the performance.
Upon announcement of the cancellation or modification of the date, time or place of a show for which the Customer has reserved seats, the Customer agrees that the Seller, as far as possible when it has itself been notified by the Organizer, may use the contact details entered at the time of booking to keep the Customer informed of the procedure to be followed.
9. OBLIGATIONS OF THE CUSTOMER
The Customer holding an access permit is prohibited:
To sell or exchange or attempt to sell or exchange the access title for valuable consideration, the rights relating to the access title to third parties. To esale or attempted resale without the agreement of the event organizer may be subject to prosecution.
To use or attempt to use the access title purchased for promotional or commercial purposes, in particular within the framework of any competition, lottery, commercial gift or any other action of this type, which is the subject of a package or more generally of any form of visibility whatsoever.
To associate or attempt to associate in any way whatsoever its name or the name of an organization of any kind (companies, associations, brands ...). In case of non-compliance with this clause, the Seller reserves the right to withdraw the validity of the access ticket and the holder may be refused access to the stadium or be expelled.
To photograph, film, record or retransmit by any means, in particular via the Internet, the event shown on the front or to assist any other person in doing so. To ensure the safety of the public, the halls may be equipped with a video surveillance system under the control of judicial police officers, which may be used in the event of criminal proceedings. A right of access is provided during the 7 days of conservation of the images. In addition, spectators are warned that in the event of filming a film or television broadcast of the event, their image may appear in it.
The Customer who holds an access permit commits himself:
In the event that the purchaser purchases one or more access passes on behalf of one or more beneficiaries free of charge, the latter must read these GTC and the Internal Regulations.
That the use of the access card is only for his personal use.
Not to use the content of the Organizer's event, as this content is the property of the Organizer. The Customer undertakes, for example, not to fix, copy, distribute, transmit, broadcast, represent, reproduce or publish all or part of the images and sounds of the event.
In order to preserve sporting ethics and the integrity of the competitions, to bet on the competition concerned within the stadium or arena by any means or process whatsoever. The FFBB reserves the right to take any and all measures, up to and including expulsion from the stadium or arena, in the event of a violation of this prohibition.
10. RESPONSIBILITY
The French Basketball Federation is responsible for the proper performance of the obligations resulting from the contract concluded at a distance, whether these obligations are to be performed by itself or by other service providers, without prejudice to its right of recourse against them. However, the French Basketball Federation may be exonerated from all or part of its responsibility by providing proof that the non-performance or poor performance of the contract is attributable either to the Customer, or to the fact, unforeseeable and insurmountable, of a third party to the contract, or to a case of force majeure. Likewise, the French Basketball Federation shall not be held liable for any inconvenience or damage inherent to the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses. The French Basketball Federation cannot guarantee and, consequently, cannot be held responsible for malfunctions or breakdowns occurring on the Vendor's servers that are not of its own making as well as malfunctions or breakdowns occurring on the networks interconnected to its own.
11. NON-COMPLIANCE WITH THESE GVC'S
The Customer whose behaviour is incompatible with these GTC or whose access permits have not been obtained in accordance with them, will have his order cancelled and/or will be refused entry into the enclosure or will be expelled from it. In the event of a breach of the GTC, the Customer shall not be entitled to any reimbursement or compensation of any kind whatsoever and the organizer may require the return of the access ticket. Finally, it is agreed that the fact of not taking advantage at a given time of any of the present GCS cannot be interpreted as a waiver on the part of the French Basketball Federation of its right to take advantage of any of the provisions of the present GCS at a later date.
12. RIGHT TO IMAGE AND PERSONAL DATA
Any holder of a ticket attending a match expressly acknowledges that it is a public event and grants the French Basketball Federation the right to use his or her image on any promotional support in relation to these various events. Answers relating to personal data are optional with the exception of surnames, first names and full addresses, which are compulsory for the acquisition of the access title, for the processing and routing of orders, the establishment of invoices.
Failure to provide this information will result in the non-validation of the order. In accordance with the law "Informatique et Libertés", the processing of information relating to the holder of a title of access has been declared to the Commission Nationale Informatiques et des Libertés (CNIL) and is intended for the commercial promotion of the Seller. The recipients of the data are the Seller's marketing and sales departments. The data may be transferred to their commercial partners for canvassing purposes. The holder of a title of access has a right of access, modification, rectification and deletion of data concerning him, which he can exercise with the marketing and sales department of the Seller. The holder of a title of access can also, for legitimate reasons, oppose the processing of data concerning him. PROMOTIONAL OFFERS The Tickets may be the subject of promotional offers. Any special promotional offer will be subject to these GTC, in the event of any contradiction between the terms of the special offer and these GTC, the terms of the special offer will prevail. The French Basketball Federation reserves the right to modify the terms of the special offers or to withdraw them at any time. Any order placed before the offer is withdrawn or modified will be honored under the conditions in force at the date of the order.
13. LEGAL WARRANTY AND CLAIMS
In accordance with the regulations, the French Basketball Federation undertakes to respect its obligations relating to the guarantees attached to the services sold, which appear among others in the Consumer Code and the Civil Code. Except in case of legal guarantee, any operation between the French Basketball Federation and the Customer, not contested within 6 months, cannot give rise to a claim. For all requests and complaints, the Customer may, by letter, contact the Ticketing Department of the French Basketball Federation.
14. DISPUTES
These GTC are governed exclusively by French law. Any dispute relating to the interpretation and/or execution of the present terms and conditions must, in the first instance, and as far as possible, be settled by amicable negotiations. In the absence of an amicable agreement, any dispute shall be submitted to the competent courts.
